President Bush Signs New Law With Potential To Eliminate Five Million American Jobs: TMC President Rich Tehrani Speaks Out Against New Legislation

NORWALK, Conn.--(BUSINESS WIRE)--March 14, 2003--President Bush signed legislation submitted by the Federal Trade Commission (FTC) designed to eliminate outbound telemarketing. Through its proposed national Do-Not-Call list, in addition to many other changes to its Telemarketing Sales Rule, the FTC will make conducting business by phone extremely difficult, if not impossible, for countless American companies. Yet, provisions in the Rule provide exemptions for politicians.

Rich Tehrani, Technology Marketing Corporation (TMC®) president and group editor-in-chief, is adamantly opposed to this new legislation. In a recent issue of Customer Inter@ction Solutions®, a leading call center and customer relationship management technology trade magazine published by TMC, he cited that roughly 3,500,000 Americans are actively involved in the outbound telemarketing industry, and that an additional 1.5 million American jobs in manufacturing, distribution and other spaces rely on outbound telemarketers for their viability.

"Our country is currently in the middle of a very difficult economic downturn, which, in large part, is caused by a lack of sales and consumer spending," said Tehrani. "The FTC's plans to kill outbound telemarketing, one of the most effective sales and marketing tools in business, will inevitably put a financial stranglehold on corporate America, eliminating countless American jobs. The federal government's endorsement of a National Do-Not-Call list, in addition to other draconian restrictions, gives this list tremendous free publicity and will likely cause a larger number of consumers to add their names to it. The government's new list ignores the fact that the call center industry has been effectively policing itself with a Direct Marketing Association (DMA, www.the-dma.org) sponsored list for over 25 years."

Existing Consumer Safeguards For Outbound Telemarketing

In addition, Tehrani states, "Besides the DMA list, there already exists a wealth of safeguards that enable consumers to restrict and even eliminate unwanted telemarketing calls, making this proposed legislation unnecessary."

These measures include:

More than 20 states currently maintain their own do-not-call lists.

Call blocking technology available from telephone companies such as SBC enables individuals to stop all telemarketing calls from reaching them.

Caller I.D., call-waiting caller I.D. and Internet caller I.D. allow people to identify incoming calls and avoid telemarketers, if they wish.

There are numerous inexpensive devices that consumers can purchase to eliminate most telemarketing calls.

Do-Not-Call Lists Do-Not-Work As Planned

According to Tehrani, the very premise of a household Do-Not-Call list is flawed. "The logic of placing one number on a do-not-call list makes no sense when a phone number is shared by many people. Depending on the circumstances, if a person places their household telephone number on such a national list, no calls will be received for magazine subscription renewals and other calls of interest pertaining to other family members."

New Technologies Help International Companies Avoid New Rule

Internet telephony, a relatively new technology that allows the use of the Internet to transmit telephone calls, enables telemarketers from any country to call the U.S. for pennies or less per minute. According to Tehrani, this technology, while traceable, makes it more difficult for the government to track calls not originating within U.S. borders. "Once traced, the U.S. government must then find the offending company, negotiate with the appropriate foreign government and then fine the offending company. The FTC and U.S. government will have to chase tens of thousands if not hundreds of thousands of international companies to enforce these fines, making this a law impossible to enforce beyond the U.S. borders. We will be handing international competitors an unfair economic advantage by allowing them to call anyone on the list without fear of government fines!"

American Jobs Will Move Overseas

According to Customer Inter@ction Solutions® magazine, even without this excessive regulation, call center jobs are rapidly being moved to other countries such as India where the standard of living is lower than that of the U.S. and the population is highly educated. This law may stop American companies from calling U.S. consumers, but it will be virtually impossible to enforce against companies selling products where the call originates outside the U.S.

American Companies Move Overseas

Tehrani added, "In essence, this law will send many American companies to other countries where they will be able to pay lower wages, lower rent and have virtually no fear of legal consequences regarding this Rule. The result will be the crippling of the U.S. business community as a whole."

Tehrani also said, "A little known fact is that handicapped workers and single mothers are two of the largest groups employed in telemarketing. Destroying the industry that helps this group of Americans is unthinkable." An upcoming editorial in the April 2003 issue of Customer Inter@ction Solutions® magazine will detail actual stories of workers who will be displaced by this new law. "This law will damage our business community, and drive millions of American jobs and numerous American companies overseas," said Tehrani.

"What is truly ironic is that as the Bush Administration attempts to bring more jobs to rural America, they will be simultaneously shutting down one of rural America's largest employers: outbound call centers. This rule is unnecessary, defies reason and logic, and will force our already sluggish economy to plummet to unthinkable depths," added Tehrani.

Yet the Kyoto treaty would have cost thousands of jobs for Americans, yet you killed Bush for pulling out of that....

I just read an article on that--good timing...don't ask me to regurgitate the data though....I just remember the theme of the article---I think it was Time

BP Amoco realized $600 MILLION in annual cost savings as a result of efficiencies in its manufacturing process realized by meeting the Kyoto protocols. BP is also realizing profits from selling its emissions credits to other firms. No one was laid off as a result of the changes either.

oh yes...such a painful treaty...reminds me of when the auto industry was bitching after the EPA toughened emissions standards in the 1970's

telemarketing is fucking bullshit...most of the $$$ are made off of lonely old people that just want someone to talk to and are easy dupped into thinking they want a product that they were not even in the market for.....thank god these scumbags will not be able to call me anymore....to top it off look at who is writing the article....

a job is a job and money is money..that is a lame sad excuse for these people losing their security...people would die to come to this country and work as a janitor,a garbage man, whatever "lowly" job most people would not consider doing...

that still means you're going to have more poor families,more people on welfare,more problems overall.....this administration is screwing up a lot of people's lives...
