They've installed a program that eliminates/blocks certain artists and songs from coming up in their search engine, therefore you can not download them. And from what I understand, they've also installed another program that is able to identify if you're downloading copyrighted material, and if so, it can then block you from using their service. It is up to the record labels to provide Napster with a list of their repertoire which needs to be blocked. Napster was also given a 'loan' by one of the major labels in excess of $50 million to come up with a business model for their service, i.e. a subscription or per download way to charge users. If they came up with a successful mode of business that all the major labels agreed to, they wouldn't have to pay the loan back. The loaning label would get an equity share in Napster. This is where the $5/month thing came from. I think the CEO of Napster said that they were wroking on this subscription model and threw out a $4.95 figure at some conference. The press went nuts with it. They have yet to implement this and as was previously stated, will not just begin billing people. In the same way that you sign up for AOL for $20/month or whores.com for whatever porn sites charge, you may have to sign up for Napster.
