  1. Breaking News: FBI Tracking Plane With Suspected Terrorist As It Nears NYC

    FEBRUARY 28TH, 2002

Law enforcement officials tell NY1 that a man believed to be on the FBI's "terrorist watch list" is aboard an Air India flight scheduled to land at JFK Airport this afternoon.

The plane is being escorted by U.S. and Canadian fighter jets, and authorities are prepared to intercept the passenger upon landing. Authorities say the jets are not visible to the passengers.

The North American Air Defense Command tells the Associated Press it is "aware of a potential situation aboard an Air India flight" and is monitoring it.

An airline official says "there is no problem with the flight" itself.

A spokeswoman for the Federal Aviation Administration in New York says Air India Flight 101 is due at JFK at 4:50 p.m.

  3. Federal Appeals Court Overturns Convictions Of Three Officers In Louima Case

    FEBRUARY 28TH, 2002

    Filed at 11:00 a.m.

A federal appeals court has overturned the convictions of three police officers in the 1997 Abner Louima torture case.

The U.S. Second Circuit Court of appeals on Thursday overturned the convictions of Charles Schwarz, Thomas Wiese and Thomas Bruder, who were all found guilty of charges stemming from the assault on the Haitian immigrant.

The appeals court says the convictions are being overturned because of insufficient evidence.

The court says Schwarz's civil rights conviction must also be thrown out and a new trial ordered because Schwarz was denied effective counsel and the jury was exposed to prejudicial information during deliberations.

Schwarz was convicted of holding down Louima while another officer, Justin Volpe, sodomized the handcuffed prisoner with a broken broomstick in Brooklyn’s 70th Precinct bathroom in August 1997.

Schwarz denied being in the bathroom when Volpe carried out the attack, but after Volpe pleaded guilty a jury convicted Schwarz in 1999 of violating Louima's civil rights by restraining him during the assault.

Schwarz is serving a 15-year sentence; Volpe pleaded guilty and was sentenced to 30 years.

Bruder and Thomas Wiese were sentenced to five years for conspiracy to obstruct justice, but were released pending an appeal.

NY1 will have more information on this breaking story as soon as it becomes available.

  5. Carjacked Vehicle Runs Over Seven In Midtown; Driver At Large

    FEBRUARY 14TH, 2002

Seven people were injured in Midtown Manhattan Thursday by carjacked vehicle, and the driver, believed to be armed, fled into a nearby PATH station, according to police.

The incident happened at 11:20 a.m. at 34th Street and Seventh Avenue, the same busy intersection outside Penn Station where a hit-and-run driver struck a pedestrian two days earlier to start a rampage that ended up injuring 18 others at two other intersections. At this time, police do not believe the incidents are connected.

Police say the car in Thursday’s incident, a gray Volkswagen Jetta, had been carjacked at gunpoint earlier from a shopping mall in Secaucus, New Jersey. Police say it was traveling eastbound on 34th Street when it jumped the curb and struck three pedestrians. The car then continued eastbound and hit four more people according to police.

Police say the driver then abandoned the car in Herald Square - 34th Street and Sixth Avenue - and fled down the stairs into the PATH station there. Officers in riot gear entered the station, which is also connected to two city subway lines, but authorities believe the driver escaped by train.

Police believe he is armed and dangerous.

Four of the victims were taken to St. Vincent's Hospital and are listed in serious but stable condition. Officials at Bellevue Hospital say two of the victims sent there may be released by the end of the day, but a 28-year-old man who suffered blunt trauma to the head is in critical condition.

All of the victims are adults.

Meanwhile, police believe the prime suspect in Tuesday’s incident, 39-year-old Ronald Popadich, may have fled to Philadelphia. Police said the New Jersey man was last seen Tuesday night at Penn Station buying an Amtrak ticket to Philadelphia, though they are not sure if he actually boarded the train.

Popadich is also wanted in connection with the shooting of a woman in New Jersey last weekend. Investigators found the purse of the shooting victim and some bullets in the car that police say was used in the rampage through Manhattan on Tuesday.

Police say the car, registered to Popadich, plowed into pedestrians at three different busy intersections in Manhattan Tuesday before it was abandoned with the engine still running in Chelsea.

None of those injuries were life-threatening.
