Club king Peter Gatien wants to do what the city and state have failed to do for more than five years - put himself out of business. Once ruler of Manhattan's night life, Gatien wants out of the business altogether - and is on the brink of selling his two remaining clubs, Tunnel and Limelight to a yet-undisclosed buyer, his lawyers said yesterday. Since the mid-'90s, city regulators and state liquor officials have unsuccessfully tried to shut down Tunnel and Limelight for allegedly selling booze to minors, allowing patrons to buy and deal drugs and looking the other way when assaults and drug use in the club turned fatal. On Monday, a 16-year-old Brooklyn boy - two years too young to be allowed inside - was stabbed after a fight that started at Tunnel spilled outside into the surrounding blocks. Gatien lawyer Benjamin Brafman stressed that the stabbing occurred only after club security properly ejected the brawling teens from the premises. But the death, and the shooting injury of another teen in the same incident, outraged city officials, who huddled yesterday over legal strategies for closing the West Side dance club. Deputy Mayor Rudy Washington said city lawyers may use the stabbing to bolster their ongoing action in Manhattan Supreme Court to close Tunnel. Other possible remedies include joining with city fire, buildings, consumer-affairs and health officials in cracking down on possible violations, along with continuing to work with state liquor officials in revoking the club's liquor license, Washington said. "There is something radically wrong there when we have a 16-year-old dying in the street and a judge can't see fit to close the place," he said. Previous incidents at Tunnel include the January 1999 overdose death of 18-year-old Jimmy Lyons and the February 2000 shooting of 27-year-old Ivory Davis. But given Gatien's lawyers' knack for forestalling all previous closing attempts - the city's nuisance-abatement action has lingered unresolved since 1999, and efforts by the State Liquor Authority to yank the Tunnel's liquor license has dragged on for four years - the club king may well beat them to the punch by shuttering his own nightclubs. "It would be fair to say the negotiations are well under way," Brafman said, declining to name who is in line to purchase the clubs' assets. The two clubs are under contract to be sold, although the deal has yet to be closed, said an official familiar with the proceeding who asked not to be named.
