As of right now Pawn Shop is breaking the law

by The Honky Tonk Man on Sat Dec 01, 2007 7:11 pm

The meeting mins are posted and guess what, I was right, no resolution.

See it for yourself here

here

So what does this mean?

I'll break it down for you:

The next opportunity to get the permit is 1 day prior to the event. Therefore all and any marketing materials for this event violates the law.

Until you have said permit, you shouldn't be allowed to advertise that you are open after hours. To me in my opinion is pure fraud.

They don't even tell you that they are even applying for one or expect one. I do believe if they apply they will get one but nothing is still certain. My assumption is since Karu got one why not Pawn Shop?

What are the consequences of staying open past 5am?

Manager on duty, can be arrested.

Any bartender on duty who serves a drink can be arrested.

Any person with a drink in their hand, can be arrested.

Any bartender who has gone thru responsible vendors knows you can't serve past 5am, no matter what unless you have the permit. Ergo if you work at PS you better find the fuck out before you go in that night. There is no fing way the other clubs on 11st haven't already contacted code enforcement about this.

Remember the city already wants that property, why not just shut them down for liquor violation?

I wouldn't be caught dead in that club past 5am the night of the party, the problem is, unless you go to the next CC meeting, we won't know in time since it takes day for the mins to show up..

The following people should be ashamed of themselves for deceptive marketing:

1. Diego Martinelli, you know better, you worked downtown for Space

2. Track, you people are ass clowns for even throwing this party when it's clear it's violating the law

3. Paul Morris, who already knows this is illegal. Why would you risk doing a party that people can be arrested at when you know it's not legit? Greed?

4. Pawn Shop's managers, staff and owners. Desperate? Greed? You know the law, you know you can't stay open past 5am, yet you are going to advertise it anyways?

5. Pod, you know better, it's your board, and you know it's a scam.

6. Want Tix for not taking down the false material.

7. Any promoter, including my friend Ramon. I told you it's not legit, yet nothing seems to be done about it.

Why am I posting this? I'm tired of these clubs ripping people off. It has to stop. Until they have the permit, they need to be honest and truthful and not put their employees futures in jeopardy with risk of getting arrested. Plain and simple.

My name is Ben and I am using Brando's login. I am the manager if the Pawnshop and I have worked for the company 3 years .

First off you don't know what you are talking about because I can be open for 24 hours but I cant sell liquor 24 hours .

I only stay open 24 hours durning WMC and yes I do get a permit for that .I do stay open after 5 am a hand full of times a year . When I do that its for something special and I dont sell liquor during our restricted time frame.

In my eyes the Richie/Cooljunkie party is very special to me .So calling us greedy is silly because I will most likely make very little money not selling liquor during our restricted time frame but I will stay open for the real Richie/cooljunkie fans.

Oh and one more thing who said that the city wants us out because the city is my landlord and they just gave me a 2 year extension on my lease. So if they want me out then thats news to me .

So while we are all partying with Richie/cooljunkie you can stay at home posting on forums and looking up internet porn.

Here you go:

Sec. 4-3. Hours during which sales allowed; Sunday sales.

(a) No distributor or vendor of intoxicating and/or alcoholic beverages or any employee thereof, on the licensed premises, shall sell, serve, offer to sell, allow to be consumed or deliver any alcoholic beverages to any person, except during the following hours:

(6) The hours of sale for alcoholic beverages by the following establishments are weekdays, including Saturday, from 7:00 a.m. to 5:00 a.m. on the following day; Sunday, from 12:00 noon to 5:00 a.m. on the following day:

a. Nightclubs;

b. Supper clubs;

c. Hotels, motels and apartments with 100 or more guestrooms;

d. Any of the establishments (above) in a retail or waterfront specialty center.

The city commission may extend the above hours of sale for alcoholic beverages for consumption on or off the premises on special occasions by resolution.

Now, why did Karu and Y go get the permit to stay open? Why do you feel because you stop selling alcohol at 5am you can stay open? For those with bottles come 5am, will you confiscate their bottles from them? Did you tell that to people who bought tix? Do they know at 5am, their 18 dollar Martini has to be tossed? If you spent the 5min and looked up the law on the web, you'd know you are 100% wrong!

Call me a hater all you want, I got the manger of Pawn Shop on record spouting off false information for the sake of greed.

Man up and tell everyone come 5am, NO MORE ALCOHOL SALES AND OR CONSUMPTION! Put it on the flyer, and the want tix site. Be an honest person and treat your customers with respect instead of these games.

As for staying open, you are flat out wrong imho. Good luck!

Hello all,

I've sat by for months and read all these posts i.e. Pawn is closing, we're greedy and misleading and so forth and so on. Most of it baseless and meritless. In this business it comes with territory. Therefore, I've never responded to any. We are still in operation and will continue to be, despite the rumor mill. My goal with Pawn Shop has never been to create controversy or criticize other venues or in any way operate unethically. I've never operated in that fashion and never will. I worry about my four walls only and I've always played well in the sandbox with others. Which brings me to why I chose to post. I'll be the first to say that I agree the advertising was a bit misleading and should and will be changed. Pawn is not handling the marketing of this event, just providing the venue. I will however take the blame as it's my responsibility to ensure it's being marketed with Pawn Shop's best interest. For this, please accept my apology. It will be remedied. Liquor sales will cease at 4:45am. Our ultimate goal is to provide our guests with the opportunity to enjoy themselves while listening to one of the best DJ/producers this industry has to offer. All this negative talk and bantering is taking the focus of what the event is really about. An amazing DJ on an amazing sound system. If the focus is only about "Why can't I get trashed between 5-7am ?" I'm afraid I can't speak intelligently on that and have no answer. I can however tell you that promoters have done a fantatsic job of getting the word out there and we are all looking forward to a stellar evening amongst friends. Please stop by and say hello, the drink will be on me. Look forward to seeing you all.

Ben - I don't know you so please do not take this as any type of personal attack. I have been in the biz for 11 years and have been an owner as well as an operator. Your interpretation of the licensing laws could not be more wrong. YOU ARE NOT ALLOWED TO OPERATE 24 HOURS PER DAY unless you are licensed as a "restaurant" and more than 60% of your revenue is derived from the sale of food.

What chaps my ass is all the venue managers and owners who don't even bother to know what their license allows them to do. I had a conversation a few days ago with a guy who runs Karu. He swore that their lawyer told him it was OK to operate 24 hours as long as they stop serving during the hours between 5 and 7 am. He told me that he actually checked and found out that I was correct and that's what led them to get a permit for the Morillo show. Why would it be more legal for you to do it? It's not!

Read the law. If you're going to call yourself a manager or operator, you really should know the basics before you go on some message board and make yourself look like a fool.

Paul - That's being a bit disingenuous. You make it sound as though someone is making up stories to try and make you look bad. Your venue along with CJ is promoting a show. The promotion claims that it will be an extended hours event. When questioned, your manager made statements claiming that PS has the ability to serve alcohol 23 hours per day. If you know the law, you know it's wrong information and that it was correct to question it. Nobody asked "Why can't I get trashed between 5-7am ?" . They asked why you were advertising an extended hours event when you have to legal right to operate after 5 am with or without alcohol. That has still not been answered despite your attempt to make it about something else.

The fact remains that it is not legal under your license to have patrons in the venue between 5 am and 7 am on Saturday morning whether you're serving alcohol or not. If it was, everybody would have afterhours......including you. So the question we need answered is this: Will Pawn Shop continue to operate after 5 am on Saturday morning for the Richie Hawtin / Cooljunkie event?

And by the way.......If "Ben" is actually your manager maybe a couple of suggestions are in order:

1. If you're going to represent your venue in a public forum please know what you're talking about.

2. If you're going to represent your venue in a public forum it's probably better to do so without the sarcasm and attitude.
