Pleasant (the relevant DCNC articles are Citizens Act to Remove Restrictions on Mt. Pleasant Nightlife Businesses and Mt. Pleasant ANC Votes Unanimously To Void All ABC “Voluntary†Agreements). These restrictions were imposed through the ill-conceived and abused "voluntary" agreement process. Please take the time now to to express support for the efforts to remove the restrictions in Mount Pleasant by emailing ABC Board General Counsel, Fred Moosally, at fred.moosally@dc.gov, with copies to DCNC at info@dcnc.org, the Mount Pleasant ANC at anc1d@yahoo.com and to rick.massumi@sablaw.com. The portions of the agreements they seek to remove are those that: 1) prohibit constitutionally protected activities, such as live music, DJs, and dancing; 2) restrict the terms of a lawful sale of the venue or license transfer; 3) prevent any licensee from advertising in any way permitted by law. I ask that you support their recommendation. “Voluntary†agreements have become a tool for extorting suppressive and often unconstitutional restrictions on ABC-licensed establishment. The process must be reformed. This motion will help pave the way for such reform. I strongly support Mount Pleasant in its efforts to remove restrictions that have infringed the rights of both businesses and citizens.
