New Twist on the Smoking Ban: 25ft rule

State unveils new restrictions for smoking ban

With just days remaining until New Jersey becomes the 11th state to ban smoking in all indoor public places and workplaces, restaurant and bar owners who oppose the action find they are facing an unexpected restriction - no smoking within 25 feet of a building.

The state Department of Health and Senior Services today made public 77 pages of proposed regulations for the smoking ban, which must be followed until they become official in late September. Included is a regulation that will put an end to any ideas restaurant and bar owners have had about creating outdoor areas where customers would be able to light up.

“This will prevent a phalanx of smokers outside the door, which is not only unsightly but unpleasant,†state Health Commissioner Fred M. Jacobs said. “And it will prevent a backwash into the restaurant.â€

There are more than 23,200 restaurants and bars statewide. The New Jersey Restaurant Association maintains the ban will harm business and that customers should be allowed to decide if they want to sit in a smoke-filled room. The organization says 67 percent of resturants are already smoke-free.

Armando Frallicciardi Jr., co-owner of Lorenzo’s Cafe in Trenton and a strong opponent of the ban, called the unexpected regulation absurd. He said a number of restaurant and bar owners, including himself, have been considering building a deck or a patio for outdoor smoking.

“This means if we build a 30-foot deck...we would have five feet where people can smoke. That is totally absurd," he said. "The state needs to work with small business on this and stop this. They have gained their objective on this. Now we need to have smoking outside.â€

In a last-ditch effort to stop the ban - at least temporarily - lawyers for restaurant and bowling alley owners plan to go before Judge Stanley R. Chesler in U.S. District Court in Trenton tomorrow to seek a restraining order on the grounds the law is discriminatory because it still allows smoking in Atlantic City’s 13 casinos. The owners maintain they will accept the ban if the casinos are included.

Now I have been reading the papers this morning, they say the law goes into affect at 12:01 AM, how many bars/clubs tonight do you think will actually make you put your cig out if your smoking at after 12:01 AM?????????

some probally will not do shit, others that go on all night till the next morning will probally not allow smoking at all tonight. we shall see.

i was ot last nite .. they actually had an annoucement at 11:55 to smoke your last cigarette's, so like 75% of the people lit up ... i couldnt breathe..lol

anyways, at 12:05 they were going around with cups collecting cigarettes from people ... fukin crazy ...

i mean, you spend $4 worth of tax on a pack of cigarettes, then you go to a club and some people spend 10, 20, 30 or more dollars to get into the club, which is owned and taxed property .... AND YOU CANT LIGHT UP A FUKIN CIG ???

is it because some pussies are out there complainign that the club is full of smoke and they dont like it??? cmon ... if people are clubbers, they are going to go whether there is smoke or not ....

i know u smoke cigs...but u smoking crack too now?? ITS about the HEALTH FACTORS..... y should other people be subjected to SMOKE...if u want to smoke fine...u have controll over ur self..but others shouldnt have to suffer...

it will hamper business for a little while till people get used to it...but i agree i loved coming home not stinking like smoke in my hair and clothes...

Im just curious, this summer if I am walking down the strret from parking my car and going to the beach. If I happen to walk right in front of DJais, less than 25 feet away, can I get in trouble. From what that says there is no smoking within 25feet of a building. I guess I ahve to stand in the middle of traffic to smoke.

I still feel in a way this is wrong. I can understand non smokers don't want to smell like smoke. Shouldn't the descion fall on the owner of the building? you spend millions to open a club or resturant and the government tells you what you can and cannot do. Shouldn't the building owner decide whether or not you can smoke in his building that he owns. If they dont want to have people standing outside than they should let places have a smoking area as long as its a seperate room, such as a small lower level or a side room with adequate ventalation.

if they are going to ban all this why not just ban cigarettes period. i smoke but its insane to see all these regulations. damned democrats have nothing more important to worry about than smoking in a club. how about welfare reform so we can lower taxes enough that non smokers can pay someone to wash thier clothes. LOL

cant smoke in public places period.... thats crazy...

its not about ur clothes smelliing that sucks too but more the health issues

For me, it's not even so much smelling like smoke when I go out. For me, I'm happy about this ban because I don't choose to smoke. When I go to a club or bar, why do I HAVE to breath in smoke filled air in these enclosed buildings? Especially when some of these buildings are very small & tight and have poor ventilation.

As a costumer, I go to the bar and spend money on drinks. I can choose to or not choose to drink when I go out. But, as a costumer, I can't choose to or not choose to breath in smoke when I go out. I have no choice but to breath in 2nd hand smoke while I'm in these buildings. Meanwhile, 2nd hand smoke is the deadliest of all. NOT COOL! I don't choose to smoke for a reason. It's not fare to the non-smokers to have to breath in the smoke. Besides the fact that some people are allergic to smoke or have other health conditions like asthma and shit.

As far as having cigar bars and stuff, that’s another story. If you show up at one of those spots and complain, you're shit out of luck! lol.

Just my thoughts! We all have rights. If I choose to live a healthier lifestyle by not smoking then I shouldn't have to suffer the smoke when I go out to a club to work or just hang out, have a drink, and listen to music!

LOL Im sure most of that fog residing over LA is from cigarette smoke.

I think its just getting time for me to quit smoking. Im glad most places I spin they usually overlook the smoking ban in the booth as long as you are descrete about it.

The only problem i have with this law is that how can this be allowed in private clubs such as the VFW halls. How do you tell someone who served in WWII, Korea, 'Nam, etc. that they can't smoke

I think its the same with a night club. If the owner owns the club and the building how do you tell him it can't go on in his building that he owns. I think the government has just too much control over what we can and cannot do.

..how the fuck are they gonna enforce 25ft in hoboken...when every 3 steps is a new bar....."uh yea but im at black bear so u can't fine me"...stupid.....and i understand people not wanting smoke..and im all about not smoking in restaraunts.....but i only smoke when i drink ....and i think it's crazy to bitch about smoke in a bar for christs sake......like going to the beach and complaining about sand..........at least make a lounge/room for smokers cause it's not fair to send them outside in sub zero weather....and i think someone should be allowed to open a bar FOR smokers....and have a sign saying WE CATER TO SMOKERS...u don't like it dont go...
