If it's your property, you should be able to do anything you like on it, short of killing someone. I do take offense to it if I'm eating at a restaraunt or bar and somoene is smoking nearby...it makes me totally lose my appetite. First of all, I totally agree that it's absurd to let the government control what we do in our homes. However, that is not exactly what's going on in this case. This story sounded more to me like a parent using the "second hand smoke is bad for my kid" card in a custody battle. In that case, I don't blame them for trying. It never occurred to me until I read this article, but if I ever found myself in a custody dispute for my child and all other factors seemed equal (job, income, ability) between me and their mother I'd use the smoking card too if it was there. The part about foster parents being restricted, well that might be going a little far but the part about it being used in custody battles makes sense to me."Still, she thinks this was not a matter for the courts because it was not proven that she posed a risk to her children's health"Argue all you want... second hand smoke is harmful to anyone .I already know the next argument... "Well what if she promises to only smoke outside away from the child?". Then you are agreeing it's ok in this case to regulate what someone does "in their own private home".
